Appeals Court Denies Emergency Stay in Legal Challenge to Deferred Action

Today, the Fifth Circuit Court of Appeals denied the federal government’s request for an emergency stay of the preliminary injunction on Obama’s expanded deferred action initiatives announced last November. The court’s temporary injunction, issued February 16, does not affect the existing DACA. Individuals may continue to come forward and request an initial grant of DACA or renewal of DACA under the guidelines established in 2012.
