Testimonials

" During the process of getting my Green Card, my husband and I had so many disastrous experiences with the immigration lawyers we were referred to; some were way too expensive, while others were just plain unprofessional. Out of desperation, we came across the website for staylegally.com and decided to give them a call. Meeting with Jessie Thomas was a refreshing change. For one, she was very flexible and worked with us, she was even willing to meet with us on Sundays! Jessie Thomas was the perfect combination of personal and professional. We connected with her almost immediately, Jessie makes it easy for you to feel like you've known her all your life. Above all, she was very professional and had such great attention to detail. The immigration process is stressful enough as it is, so it was a relief for me to have a lawyer who was all about the details and I knew I didn't have to worry about it. I will not hesitate to refer The Law Office of Jessie Thomas to any of my friends that I know are in need of such services because I know they would not be disappointed. "...More

Removal of Conditions Lawyer - Richardson, TX

Helping You Finalize Your Green Card Status

If you have obtained a green card on the basis of your marriage to a U.S. citizen or as an investor/entrepreneur, your status may be conditional, and you may be required to file for removal of conditions in order to be allowed to remain in the country permanently.

Conditional resident status is good for two years, and you are expected to stay married during that two years.

If you divorce before the two-year period ends, you can ask for a waiver of the removal status, but you will be investigated to ensure that you did not enter into marriage fraudulently.

When the conditional time period ends, you must apply to have the conditional status removed.

The reason for this law is obvious. USCIS does not want to let in people who marry fraudulently and break up a week later. The two-year wait is part of the Immigration Marriage Fraud Amendments (IMFA) of 1986.

If you fail to apply for removal of conditions after two years, a process that is not simple, your residency will be terminated, and you will be placed in removal (deportation) proceedings.

Clearly, it is important that you anticipate the two-year anniversary and file a joint petition with your spouse, including documentation supporting your request for waiver. In some cases both of you will have to submit to an interview with USCIS to back up your claims.
